These Terms and Conditions ("Terms") govern your use of tinytigerphoto.com ("the Website") and the services offered by Oktavian d.o.o. ("the Company", "we", "us", "our"), a company registered in the Republic of Croatia.
By placing an order or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Website or services.
Tiny Tiger Studio provides the following digital photo editing and photography-related services:
All services are delivered digitally unless otherwise agreed in writing. We reserve the right to modify, suspend or discontinue any service at any time with reasonable notice.
By placing an order through our Website, you make an offer to purchase the selected service. Your order is confirmed once you receive written confirmation from us by email. We reserve the right to decline any order at our discretion.
All prices are listed in Euros (EUR) and are inclusive of any applicable VAT where required. Prices are subject to change without notice, but any change will not affect orders already confirmed.
Payment is required in full at the time of placing the order. We accept payment via the methods displayed at checkout. All transactions are processed securely by our payment provider. We do not store your full payment card details.
Gift vouchers are valid for 12 months from the date of purchase. They are non-refundable and cannot be exchanged for cash. Lost or stolen vouchers cannot be replaced.
When submitting photos for editing, you confirm that:
The quality of the final edited image is dependent on the resolution and quality of the original photo submitted. We will advise you if the submitted photo is of insufficient quality to achieve the desired result, but we cannot guarantee outcomes for very low-resolution or heavily degraded images.
Submitted photos are stored securely for the duration of the project and for up to 15 days after delivery to allow for revision requests. After 30 days period, files may be deleted. We do not use your submitted photos for any purpose other than completing your order unless you have given explicit written consent.
Estimated turnaround times are provided as a guide only and are not guaranteed. Turnaround times begin from the moment we receive all required materials from you. Delays caused by incomplete or unclear instructions are not the responsibility of the Company. We will communicate any significant delays to you as soon as possible.
Revisions must be requested within 14 days of delivery. Requests received after this period may be subject to an additional charge. Revisions are limited to adjustments within the original brief. Requests that constitute a new or substantially different edit will be quoted separately.
You retain full ownership of all photos you submit to us. By submitting your photos, you grant Oktavian d.o.o. a limited, non-exclusive licence to process, edit and store the photos solely for the purpose of delivering the ordered service.
Upon receipt of full payment, you are granted a non-exclusive licence to use the edited images for personal or commercial purposes as agreed at the time of order. The Company retains the right to use edited images in its portfolio and marketing materials unless you expressly request otherwise in writing at the time of order.
All content on tinytigerphoto.com is the property of Oktavian d.o.o. or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute or use any content from the Website without prior written permission.
If you cancel your order before we have commenced work on your submission, you are entitled to a full refund.
If work has already commenced, refunds will be considered on a case-by-case basis depending on the stage of completion. No refund will be issued where the work has been fully completed and delivered.
If you are not satisfied with the result, please contact us at [email protected] within 14 days of delivery. We will make reasonable efforts to resolve your concern through revisions or partial refund where appropriate. We do not offer refunds on the basis of subjective preference where the work has been delivered in accordance with the brief provided.
Nothing in these Terms affects your statutory rights as a consumer under applicable EU and Croatian consumer protection law, including the right of withdrawal under the Consumer Rights Directive where applicable.
To the maximum extent permitted by law, Oktavian d.o.o. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services or Website. Our total liability to you in connection with any order shall not exceed the amount paid by you for that specific order.
We are not responsible for any loss of data, business opportunity, or damage to reputation arising from delays, errors, or defects in our services where such issues result from circumstances outside our reasonable control.
These Terms are governed by and construed in accordance with the laws of the Republic of Croatia and applicable European Union law. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Croatia, without prejudice to your rights as a consumer under EU law.
We reserve the right to update these Terms at any time. The updated version will be posted on our Website with a revised effective date. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.
